ATLANTA – QPWB Partner Sandro Stojanovic and Associate Juan Davalos secured a complete defense victory in a trucking liability case stemming from an alleged accident involving a tractor-trailer. The court granted the defense team’s Motion for Summary Judgment, which dismissed the Plaintiff’s claims in their entirety with prejudice and no recovery granted.
QPWB's Atlanta team was retained to defend this litigation after discovery had already expired. The case involved a person who alleged to have been injured in an accident with a client's tractor-trailer. The lawsuit the Plaintiff pursued was a renewed action, having been previously dismissed. The defense team was tasked with immediately managing the ongoing litigation and evaluating all avenues of defense against the Plaintiff's claims.
The Plaintiff claimed injuries, lost income, and pain and suffering due to the accident involving the tractor-trailer.
The defense approached the case by focusing intently on the procedural history and compliance of the litigation laws. Upon in-depth review of the case that was transferred from another law firm, the defense identified a core legal defect: the Plaintiff's failure to properly serve a defendant in the original lawsuit and then improperly substituting the other defendant without the required leave of court.
