- Pister v. Matrix Service Industrial Contractors, et al. - Circuit Court of Champaign County, Illinois Ms. McCubbin assisted lead counsel in securing a defense verdict in a wrongful death jury trial involving a nationally recognized contractor. The case centered on whether the defendant's employee was acting within the course and scope of employment at the time of a fatal head-on collision. Despite evidence suggesting the employee possessed tools consistent with work-related duties, the jury found in favor of the defense. On appeal, the verdict was upheld, and the appellate court declined to extend the "traveling employee" theory from workers' compensation to tort law.
