Arron Nesbitt is a partner in the Denver office of Quintairos, Prieto, Wood & Boyer, P.A. He is a national trial attorney with extensive experience in complex civil and commercial litigation with principal emphasis on the defense of major product liability and mass tort cases for national and international manufacturers, construction litigation, commercial trucking accidents, medical device and pharmaceutical claims dental practice and insurance matters, wrongful death, and catastrophic personal injury matters. His practice includes the representation of clients at trial, arbitration, and mediation in numerous jurisdictions, in both state and federal courts across the country, and has tried cases to verdict in numerous jurisdictions including Puerto Rico. Mr. Nesbitt has extensive experience handling sophisticated scientific, regulatory and technical issues that arise in complex litigation.
Since commencing private practice in 1999, he has combined his substantial trial experience and significant subject matter knowledge with thoughtful, strategic and creative approaches in providing clients with sensible strategies to defend difficult lawsuits.
In addition to trial work, Mr. Nesbitt counsels and assists clients with review and evaluation of corporate policies and procedures, training manuals and related employment materials. He works closely with individuals and corporate clients investigating and evaluating claims as well as active litigation matters in terms of necessary discovery, potential liability, valuation, and strategies for potential ADR and trial. In 2013 Mr. Nesbitt attained Martindale Hubbell's AV® Preeminent™ rating.
Representative experience include litigation or trial work in the following areas:
- Product Liability - defense of the automotive industry and stun gun manufacturers concerning design, manufacture and warnings defect claims.
- Construction Defect - representation of owners, contractors, subcontractors, and design professionals through all phases of construction defect claims.
- Medical Device Litigation - design, manufacture and warnings defect in blood glucose monitors.
- Commercial Litigation - breach of contract, breach of warranty, tortious interference, trade secret, premises liability, and other insurance defense matters.
Since 1999, Mr. Nesbitt has worked as an attorney with various law firms in Colorado, Arizona, and California. Prior to joining QPWB, he was a senior trial attorney with a Boulder, Colorado law firm specializing in advising insurance entities, business owners and injured parties. He represented a multitude of complex civil litigation matters, including complex business and insurance disputes with discovery and trial in defense of construction defect and product liability, commercial trucking, property, contract disputes, and other general liability matters.
Previously, Mr. Nesbitt managed the litigation team of a Denver, Colorado full-service, boutique law firm representing consumers and businesses. He handled a wide variety of commercial and personal injury matters throughout the United States, conducted claims evaluations, depositions, attended mediation and settlement conferences as well as court appearances as first chair at trial.
He was a partner at a preeminent, national defense litigation law firm in Denver where he represented multiple individuals and corporate clients in all areas of his practices pertaining to all claims and litigation management tasks in multi-million-dollar cases from initial assessment through discovery and trial. Mr. Nesbitt preserved millions of dollars for insurance clients by reviewing coverage disputes and analyzing and defending personal injury, general liability, property, and professional negligence claims in financial, insurance, building management, oil and gas, and other industries.
Mr. Nesbitt served as an of counsel attorney and partner with a law firm representing clients nationwide in areas of products liability, insurance, litigation, business, and alternative dispute. He litigated national insurance defense cases for excess liability carriers focused on personal injury, product liability, commercial trucking, premises liability, and other multi-million-dollar exposure cases. As lead trial counsel, he presented opening statements, closing arguments, and handled jury selection, in limine motions and other evidentiary disputes. He saved insurance clients tens of millions of dollars investigating and defending personal injury, product defect, and professional negligence claims in numerous industries including commercial transportation, construction, and manufacturing. He also upheld the integrity of certified financial planner's trademark and regulations by investigating and prosecuting consumer claims.
Mr. Nesbitt's other noteworthy accomplishments include:
- Appointed State Bar of Arizona Fee Arbitrator from 2005-2007.
- From 2004 to 2007, he was a contributing editor of Product Liability Desk Reference: A Fifty-State Compendium, Aspen Publishing. A comprehensive resource that provides the most recent statutory and case law developments on product liability laws for each of the fifty states and the District of Columbia.
Mr. Nesbitt received his Juris Doctor from Golden Gate University School of Law, San Francisco, California in 1999 and Bachelor of Arts from Northern Arizona University in 1993.
He is licensed to practice law in Colorado, Arizona, California, Montana, and Texas and is admitted in the U.S. District Court for the District of Colorado, U.S. District Court for the District of Arizona, U.S. District Court for the Northern District of California, U.S. District Court for the Eastern District of Texas; and the Supreme Court of Colorado, Arizona Supreme Court, Supreme Court of California, Montana Supreme Court, and Supreme Court of Texas.
