Brian E. Agard, II is an associate in the Orlando Hub of Quintairos, Prieto, Wood & Boyer, P.A. Bringing over a decade of litigation experience and 15 years of distinguished military service, Mr. Agard's passion for the Federal Government has been the catalyst for his continuous pursuit of growth. His practice is shaped by extensive experience in military justice, litigation, administrative law, financial services, and regulatory compliance.
As a U.S. Army Reserve Special Victims' Counsel Regional Manager, Mr. Agard provided representation and oversight for victims of serious crimes within the military justice system, ensuring their rights are protected throughout the investigative and trial process. His role also involved supervising multiple attorneys and paralegals, assigning cases, and providing legal training to military stakeholders.
Previously, as a Trial Counsel for the U.S. Army Reserves, Mr. Agard represented the military in courts-martial and administrative proceedings, handling cases involving misconduct, administrative separations, and disciplinary actions. His role required extensive litigation, case preparation, and legal research into military law and compliance with Army regulations.
Mr. Agard's experience includes serving as a Legal Administrator for one of the largest one-star commands in the U.S. Army Reserves, overseeing military investigations and ensuring compliance with federal and military regulations in cases involving discrimination, equal opportunity violations, and financial liability investigations. He has worked extensively on cases related to sexual assault complaints, involuntary separations, fraudulent enlistments, and security clearance violations.
Throughout his career, Mr. Agard has demonstrated exceptional litigation skills and leadership in challenging environments:
- Ensured performance excellence in the Office of the Staff Judge Advocate for the 143rd Sustainment Command, providing legal oversight for a force of approximately 10,000 soldiers.
- Administered and managed more than 700 legal cases annually, covering misconduct, involuntary separations, sexual assault complaints, fraudulent enlistment, and security clearance violations.
- Provided legal guidance in highly sensitive matters, managing complaints of sexual harassment, sexual assault, and EO violations against leadership, all subject to UCMJ prosecution.
- Assisted in the development and execution of Commander Reports and recommendations, ensuring adherence to military legal standards and regulatory compliance.
In 2015, Mr. Agard earned his Juris Doctor from Florida A&M University College of Law and a Bachelor of Arts in Legal Studies from the University of Central Florida. Licensed to practice law in Florida, he also holds Secret Security Clearance and has been recognized for his service with multiple military honors and awards, including:
