James M. Fishman is a partner in the Miami office of Quintairos, Prieto, Wood & Boyer, P.A. Mr. Fishman has handled insurance defense matters for over 38 years. He has extensive experience litigating a wide variety of matters in the areas of insurance coverage, first party insurance claims, third party tort liability claims and all types of liability including sovereign immunity related matters, medical, legal and other professional malpractice matters; and real estate litigation foreclosures, title insurance claims, and commercial litigation. He also handles appeals at all levels. In these matters, Mr. Fishman represents the state of Florida and its agencies, major insurance carriers, governmental entities in defense of negligence claims and the alleged mishandling of virtually any duty - from design to implementation of operational policies and maintenance - and businesses that provide services to the public and other commercial interests throughout the state. He also has extensive mediation experience and has represented hundreds of cases as a litigator as well as having extensive experience as a Certified Florida Supreme Court Circuit and Civil mediator. In addition to his extensive list of representations on behalf of national insurance carriers, he has successfully represented one of Florida's largest property insurance carriers before the Florida Supreme Court.
Mr. Fishman has attained a rating of AV® Preeminent(TM) from Martindale Hubbell Law Directory; the rating is the highest level secured by his peers and the judiciary for ethical standards and legal ability. His other achievements include being selected to chair the Florida Bar Grievance Committee, and serving on the Dade County Bar Associations' Real Property and Civil Litigation Committees.
Throughout his years of practice, Mr. Fishman has defended property insurers throughout Florida in first-party coverage matters, where many of the claims involve windstorm, sinkhole, fire, mold, theft, and water losses. Prior to joining QPWB and since 1994, Mr. Fishman was principal and senior trial attorney of his law office, James M. Fishman, P.A., in Miami. Previously, he was a partner and president of Fried and Fishman, P.A., a statewide litigation practice, where he represented the State of Florida Department of Insurance as well as various mortgage interests. Mr. Fishman previously had worked with an insurance defense law firm handling insurance defense and coverage matters representing the City of Miami Beach, City of South Miami and various casualty and insurance companies.
Mr. Fishman received his Juris Doctor from The John Marshall Law School, Chicago, Illinois in 1979 and Bachelor of Arts form the University of Miami in 1976.
Mr. Fishman is licensed to practice law in Florida. He is a member of The Florida Bar and is admitted to practice before the U.S. District Court for the Southern, Middle and Northern Districts of Florida and the U.S. Court of Appeals Eleventh Circuit.
Mr. Fishman is a lecturer and speaker at national and local conferences. As a member of the Windstorm Insurance Network, he has lectured to insurance professionals and lawyers on topics related to general liability issues and insurance law practice.
Throughout his career he has been active in bar associations, business networks and claims industry organizations.
