John W. Tomasik is a senior partner in the Farmington Hills Hub of Quintairos, Prieto, Wood & Boyer, P.A. Mr. Tomasik has practiced law in Michigan since 2004, concentrating on the defense of employers and insurers in workers' compensation claims. His work spans a range of sectors including education, healthcare, manufacturing, transportation, and retail. He is particularly experienced in navigating claims involving public entities and regularly presents training seminars on Michigan Workers' Compensation law to claims professionals nationwide.

Mr. Tomasik is trusted counsel for one of the country's largest grocery retailers, representing them in high-volume, high-risk workers' compensation claims. Known for his assertive litigation and negotiation skills, he is equally adept in the courtroom and at the facilitation table, helping clients reach early and effective resolutions when appropriate.

A proud graduate of the University of Michigan and Michigan State University College of Law, Mr. Tomasik began his practice with a background in public service, having served as a legal intern with the Michigan Department of Attorney General during law school.

Raised in Sterling Heights, Michigan, Mr. Tomasik now resides in West Bloomfield with his wife, Kate, and their two children. Outside of work, he enjoys golfing and cheering on the Detroit Tigers, Red Wings, and University of Michigan sports teams. Mr. Tomasik is actively involved in professional organizations including the American Bar Association, the Michigan Self-Insurers' Association, and the Workers' Compensation Section of the State Bar of Michigan, where he serves as a Council Member.

Mr. Tomasik is licensed to practice law in Michigan and before the U.S. District Court for the Eastern District of Michigan.

Representative Cases:

  • Mr. Tomasik recently defended a wrongful death claim involving a worker who contracted a fatal infection following reconstructive hip surgery tied to a job-related fall. The plaintiff's estate sought over $1,000,000 in damages, including lost wages, funeral expenses, and nearly $500,000 in medical bills.
  • At facilitation, Mr. Tomasik successfully argued for the dismissal of the medical providers' claims due to lack of standing. He also presented compelling financial evidence showing the plaintiff's spouse was not a total dependent based on her income and assets.
  • Mr. Tomasik further convinced the magistrate that the present value of future wage loss was far less than the $600,000 demanded by the estate. The case ultimately resolved for under twenty percent of the plaintiff's original demand.
  • In a separate case involving an alleged frostbite injury while installing satellite dishes, Mr. Tomasik revealed that the plaintiff had a history of drug-seeking behavior. His cross-examination of the treating physician uncovered a suspicious claim that the plaintiff's pain medication had been eaten by a neighbor's dog leading to a quick settlement at nuisance value, despite an initial demand of $75,000.
