The Plaintiff sued our client for injuries claimed from a bicycle accident. The Plaintiff claimed damages arising from an October 24, 2021 bicycle accident. The dispute centered on injuries allegedly caused by that incident, including asserted dental trauma and bodily injuries to the neck, back, and left shoulder. The Plaintiff asserted these were new injuries and denied any pre-existing conditions, which defense records later proved to be false.
Our defense strategy focused on building a fact-driven record showing the plaintiff’s story did not match the documents. Our motion relied on sworn testimony from the dental practice’s manager, confirming a key invoice did not originate from their office, and lined up the plaintiff’s sworn statements against the paper trail. Alongside undisclosed, pre-accident orthopedic treatment, these inconsistencies formed a clear pattern the Court evaluated in the aggregate rather than as one-off errors. The Court dismissed the case with prejudice.
