QPWB has secured a complete defense victory for an insurance company client in the Brevard County Circuit Court, securing a complete dismissal. The court granted Miami Partner Dexter Romanez's motion to dismiss for fraud on the Court, effectively ending the lawsuit that had an alleged personal injury with over six-figures in medical expenses.

Overview of the Case

The Plaintiff sued our client for injuries claimed from a bicycle accident. Throughout discovery, the defense developed compelling evidence that the case was tainted by fraud, including a fabricated dental “bill,” false testimony about prior accidents and medical history, and inconsistent claims regarding lost income and criminal history. The court granted the defense’s motion and dismissed the action with prejudice, finding a sustained scheme of fraudulent conduct by the Plaintiff.

Claims Made Against Our Client

The Plaintiff claimed damages arising from an October 24, 2021 bicycle accident. The dispute centered on injuries allegedly caused by that incident, including asserted dental trauma and bodily injuries to the neck, back, and left shoulder. The Plaintiff asserted these were new injuries and denied any pre-existing conditions, which defense records later proved to be false.

Defense Strategy

Our defense strategy focused on building a fact-driven record showing the plaintiff’s story did not match the documents. Our motion relied on sworn testimony from the dental practice’s manager, confirming a key invoice did not originate from their office, and lined up the plaintiff’s sworn statements against the paper trail. Alongside undisclosed, pre-accident orthopedic treatment, these inconsistencies formed a clear pattern the Court evaluated in the aggregate rather than as one-off errors. The Court dismissed the case with prejudice.

Impact on Final Outcome

Our evidence-driven approach was critical in transforming a credibility dispute into a clear and convincing pattern of fraud. The defense's methodical presentation, which included front-loading sworn, third-party testimony, was expressly credited by the court in its findings. The court's order adopted our structure almost verbatim, finding multiple instances of fraudulent conduct that warranted the dismissal.

Unique Aspects of the Case

The most unique aspect of the case was the fabricated $3,000 dental “bill,” which defense counsel uncovered through targeted discovery. The fact that the provider’s practice manager provided sworn testimony that the bill was not generated by their office was a powerful piece of evidence that directly played a critical role in the court’s findings of fraud.

Predicting the Future

This victory materially elevates QPWB’s credibility with carriers and the bench, as it demonstrates that we don't just "argue fraud"—we prove it with a clean, evidence-based record. This reputation translates into stronger negotiating leverage, as plaintiff's counsel knows we will chase fabrication to the end. The outcome leads to earlier and better settlements and, where appropriate, fee recovery that offsets defense spend and improves claim economics for our clients.

This win also provides a repeatable playbook for proving fraud through focused discovery, side-by-side impeachment of sworn statements, and strategic briefing. This allows us to deploy templates for discovery and continue to train associates on fraud pattern-spotting. For future clients, the effect is faster exposure control, lower litigation costs, and a credible deterrent to inflated or fabricated claims.

● Evidence-Driven Defense: Proved a sustained scheme of fraudulent conduct with third-party testimony and detailed records
