Premises Liability: Defense Verdict For The Billiard Club
MIAMI – Jeffrey R. Creasman (Miami), partner at Quintairos, Prieto, Wood & Boyer, P.A. (QPWB), achieved a defense verdict on behalf of The Billiard Club, where a patron sustained a fall causing her to sustain multiple shoulder fractures. The case of June Lightfoot vs. The Billiard Club was tried before Judge Jon Gordon of the 11th Judicial Court of Miami-Dade County, where after three days of trial, the jury deliberated for 40 minutes before returning a defense verdict and finding no negligence on the part of the defendant.
The Plaintiff, June Lightfoot, a pool league sponsor and regular player at The Billiard Club, testified that poor lighting at the Club caused her to trip and fall on a step that separated the bar area from the pool tables, causing multiple shoulder fractures. She claimed that severe functional impairments would persist for the rest of her life. Lightfoot’s husband testified his wife was living in pain and her injuries impaired her day-to-day activities. Additionally, her treating physician testified that the Plaintiff would require additional physical therapy and surgery in the future.
The defense’s medical expert refuted Plaintiff’s claims of permanent injuries, testifying that the Plaintiff had recovered full function in the shoulder and that she would not require further medical treatment. Through aggressive discovery investigation the defense was able to prove that the Plaintiff never attended the physical therapy initially ordered by her treating physician.
The defense also established that the Plaintiff was familiar with the layout of the facility, and that the lighting at the time of the incident was nearly identical to the lighting at the establishment that existed on the Plaintiff’s prior visits.
