QPWB ATTAINS A DEFENSE VERDICT ON VEHICLE COLLISION CLAIMS
GWINNETT COUNTY, Ga. ― Craig R. White, a partner in the Atlanta office of Quintairos, Prieto, Wood & Boyer, P.A., received a defense verdict on behalf of a delivery truck driver employed by a linen and workwear rental company.
The Plaintiff alleged a delivery truck operated by the defendant struck the front the Plaintiff’s car. Plaintiff claimed $56,354.00 in medical expenses and $36,450 in pain and suffering resulting from the incident. After deliberating approximately 45 minutes, the jury (made up of 10 women and 2 men) returned a defense verdict. Post-trial discussions with jurors revealed they did not believe Plaintiff established a collision had occurred. Photographs tendered into evidence by defense revealed no damage to Plaintiff’s vehicle. Jury never reached the issue of damages because Plaintiff could not prove there was a collision. Evidence in the record established that Plaintiff had been involved in motor vehicle collisions (and resulting claims) in 2015 and in 2020. Both claims were settled for a combined amount of $70,000.
