QPWB GETS DEFENSE VERDICT FOR NATIONAL FAST FOOD INDUSTRY CLIENT

NASHVILLE, Tenn. ― QPWB Tennessee team received a defense verdict for their client, a national drive-in fast food restaurant chain. The plaintiff alleged the defendant’s employee was negligent in handling a cup of hot coffee through the window of plaintiff’s vehicle. The lid detached from the cup causing coffee to spill on plaintiff’s lap resulting in 1st and 2nd degree burns and permanent scarring. Plaintiff sought damages for incurred medical expenses, pain and suffering, and court costs.

The plaintiff asked for a verdict finding 100% negligence of defendant. After a bench trial, the court accepted the defendant’s argument that the evidence did not support a finding that the plaintiff’s injuries were the result of the negligence of the defendant’s employee. The court awarded no damages to the plaintiff and entered a judgment dismissing the case with prejudice.
