Powell County, Kentucky ― Quintairos, Prieto, Wood & Boyer, P.A.’s medical malpractice and long-term care defense attorneys, J. Peter Cassidy a partner, and Matthew C. Cocanougher an associate, both from the firm’s Lexington office, received a unanimous defense verdict obtained on behalf of a nursing home in Powell County, Kentucky. The lawsuit included claims of negligence, medical negligence and corporate negligence by the nursing home staff.
The lawsuit claimed that the nursing home failed to provide appropriate care and treatment of a 52 year-old man treated at the nursing home for around nine months. The plaintiff alleged that the nursing home staff failed to properly suction the resident’s airways, leading to a mucous plug and hypoxic brain injury.  The defense presented evidence that the nurses appropriately assessed the resident and no amount of suctioning would have prevented his injuries. The jury found unanimously for the nursing home on standard of care after deliberating for less than an hour. Plaintiff had sought $11,500,000.00 as total compensation for the injury.
