QPWB OBTAINS FAVORABLE DISMISSAL WITH PREJUDICE IN
EMPLOYMENT AND WORKER’S COMPENSATION CASE

QPWB’s Mississippi Office Managing Partner, Amanda Alexander, recently obtained a favorable result in the form of a dismissal with prejudice on a Motion to Dismiss on the Pleadings in U.S. District Court for the Northern District of Mississippi. The action was brought by a former employee who alleged cancer from exposure in the workplace to an herbicide in Indiana several years previously. QPWB’s client was the Plaintiff’s former employer, and the basis of the dispositive motion was the exclusive remedy provision of Indiana’s Occupational Disease and Workers’ Compensation Act. Plaintiff had sued his employer, and the alleged herbicide manufacturer for compensatory and punitive damages well over $100 million dollars. His claims against the former employer were dismissed with prejudice, the court also denied Plaintiff’s request to amend his Complaint for a second time to increase his demand for punitive damages. This victory highlights the significance of QPWB’s counsel skill in both employment and worker’s compensation.
