LAS VEGAS HUB – QPWB attorneys Adam Garth, Michael Ayers, and Anna Smith recently achieved a decisive victory in a lawsuit filed against their client, a homeowners' association, resulting in a complete dismissal of the case due to discovery abuses by the plaintiffs.

Overview of the Case

The case involved a lawsuit filed by residents against a homeowners' association (HOA). The plaintiffs, who had violated the HOA’s rules and incurred thousands of dollars in fines, failed to pay the fines. As a result, the HOA imposed a lien on the plaintiffs' home. The plaintiffs claimed that these liens prevented them from obtaining loans for their bonding business and sought damages in excess of $1,200,000.

QPWB represented the HOA and defended it against claims based on unsubstantiated allegations of business losses due to the lien. The plaintiffs failed to provide supporting documentation for their financial claims, and their case was further weakened by discovery violations and perjurious testimony. Despite the plaintiffs’ initial demand for damages, QPWB secured a complete dismissal of the case, absolving the HOA of liability and ensuring that the plaintiffs were held responsible for the defense’s legal costs.

Key Difference-Makers

Claims Made Against Our Client

The plaintiffs alleged that the HOA was responsible for imposing liens on their property, which led to their inability to obtain loans for their bonding business and overall financial loss.

Defense Strategy

QPWB attorneys implemented a systematic discovery campaign to expose the flaws in the plaintiffs' case and discredit their claims. This involved uncovering how the plaintiffs amassed fines, the specific damages they sought, and whether these damages were legitimate. The plaintiffs, in turn, denied having any profit and loss statements from their business and refused to provide key financial documentation or calculations of their alleged losses. One plaintiff testified in her deposition that no financial reports, including profit and loss statements, existed for their business. However, on the evening of the close of discovery, the plaintiffs disclosed profit and loss statements they had previously denied ever possessing.

When it became clear that the plaintiffs were engaging in discovery abuses and providing false testimony, QPWB filed a Motion to Strike the Plaintiffs' Complaint and their late disclosure of documents. During the litigation, QPWB’s team effectively cross-examined the plaintiffs' expert witnesses, pointing out the lack of evidence supporting their claims. Plaintiffs also cross-examined QPWB's experts in an attempt to discredit them due to the absence of evidence upon which they based their claims, despite the fact that the plaintiffs had previously denied possessing the very evidence that their experts claimed was necessary for formulating their opinions.

After extensive motion practice and a hearing on the matter, the court ruled that the plaintiffs' multiple discovery violations warranted dismissal of their case

Months earlier, QPWB served an Offer of Judgment to the plaintiffs for a monetary sum in an effort to bring the case to a swift resolution and prevent further litigation due to the high costs associated therewith, which the plaintiffs rejected. Given that the case was dismissed, QPWB was able to pursue the plaintiffs for all costs and attorneys' fees incurred from the date of the Offer of Judgment through the date the judgment was signed and initiated post-judgment collection proceedings.

Impact on Final Outcome

Faced with overwhelming evidence of discovery violations and perjurious testimony, the court ruled in favor of QPWB’s client, dismissing the case and awarding the HOA costs and attorneys' fees. The plaintiffs were held accountable for their unethical conduct and failure to substantiate their claims. This decision effectively ended the litigation, sparing the HOA from further financial and legal exposure.

Unique Aspect of the Case

One of the most notable aspects of this case was the rare dismissal of a case in this jurisdiction due to discovery abuses. While dismissals for discovery violations are uncommon, it is even rarer for a complaint to be dismissed due to a party's misconduct. The plaintiffs' failure to provide necessary documentation, coupled with their perjurious testimony, led the court to take swift and decisive action. This outcome highlights QPWB's ability to expose misconduct early in the process and leverage aggressive legal strategies to protect their clients.

Predicting the Future

This victory underscores QPWB’s proactive approach to defending clients against frivolous claims and ensuring that unethical conduct in discovery is met with severe consequences. We are sending a clear message that evidence is necessary to prove a case and that ethical and discovery abuses will not be tolerated. We are reinforcing the principle that filing a lawsuit and seeking compensation without proof will not be permitted. By combining strategic motion practice, expert testimony, and early resolution tactics, QPWB attorneys efficiently dismantle baseless claims and secure favorable outcomes for their clients. This case sets an important precedent in the legal community, showcasing the firm’s commitment to protecting clients from unnecessary litigation and financial exposure.

Key Actions in This Case

  • Offer of Judgment: QPWB served an Offer of Judgment months before trial, aiming to resolve the case early and minimize litigation costs. The plaintiffs rejected the offer.
  • Discovery Violations & Motion to Strike: Plaintiffs repeatedly denied possessing key financial records, only to disclose them at the close of discovery. QPWB filed a Motion to Strike the Complaint based on these violations.
Expert Witness Cross-Examination: Plaintiffs attempted to discredit QPWB’s experts, despite previously denying possession of the very evidence they claimed was necessary for expert opinions.
  • Dismissal & Post-Judgment Recovery: After extensive motion practice, the court dismissed the case due to plaintiffs' discovery misconduct. QPWB then pursued reimbursement of attorneys' fees and costs through post-judgment collection efforts.
