TALLAHASSEE ATTORNEY WINS SUMMARY JUDGMENT IN
DISCRIMINATION RETALIATION CASE

John S. Derr of the Tallahassee office recently won summary judgment in an employment law case alleging discrimination on the basis of disability, and workers’ compensation retaliation. Plaintiff sustained a heart attack at work which was deemed compensable because of his law enforcement position. Plaintiff returned to work, but was frequently absent to be tested for treatment. Over the next couple years, several incidents occurred at work which, while they did not affect the terms and conditions of his employment, Plaintiff contended were evidence of discriminatory or retaliatory animus. Ultimately Plaintiff brought to work a note from his workers’ compensation cardiologist saying that his condition was such he could not return to work at all. Plaintiff was terminated. Plaintiff testified on deposition that at the time he received the note from his doctor, he was unable to work. Plaintiff’s counsel filed thousands of documents in opposition to the motion for summary judgment, to no avail. The judgment has been appealed.
